Code of Conduct

We value trust, transparency and staff, clients and partners’ wellbeing.

This code of conduct establishes behavioral and ethical patterns which are part of our essence and must be followed by all NICCHIO CAFÉ staff and third-party companies. It is a relevant governing resource and brings, clearly and in a didactic manner, the behavior which is expected in everyone’s daily life. Its importance is to guarantee dignity and honor in professional relations. Any violation will be assessed by the board of directors, who will take sensible actions so that our values are not affected.

We recommend reading attentively. The defined conducts are mandatory for all of those who have any connections with the company.

1 - THINK BEFORE YOU ACT

Before making a decision, observe if it is within the law, if it is part of the code of conduct and the company’s values or if you would be proud in telling family and friends about your actions. If the answer is negative, it is best to consider.

2 - SOCIAL MEDIA BEHAVIOR

Public-related behavior is important to the building and maintaining of NICCHIO CAFÉ’s image and reputation. Therefore, one must act accordingly to the company’s values and principles, as inside so outside it.

In using social media, it is necessary to respect NICCHIO CAFÉ’s beliefs and values. You may include the company’s name in personal Facebook, Instagram and other platforms’ posts, as long as it does not do any harm to our image and reputation, does not violate our policies and does not contain confidential information.

3 - ETHICAL PRINCIPLES

Integrity: this principle involves being honest, fair and coherent in all your actions and decisions, following adequate moral and ethical patterns.

Responsibility: it refers to taking accountability for your actions and decisions, and not blaming other people or external circumstances for your decisions.

Respect: all people must be treated with dignity and respect, no matter their differences, opinions, race, age, political view, religion or sexual orientation.

Transparency: it is about being honest, open and transparent in your relations and communication, not hiding relevant information or deceiving others.

Professionalism: making fair and impartial decisions, without any bias or prejudice, therefore, guaranteeing equity in all your actions.

Thoughtfulness: ethical caution envolver being sensible to others’ needs, showing empathy, compassion and concern, acting with diligence and zeal in order to avoid harm to third persons.

4 - HARASSMENT

The term “harassment” is used to describe verbal or physical actions that seek to humiliate, coarse or threaten people. Such practice also includes creating a hostile working environment which can affect personal performance and jeopardize other collaborators’ working conditions.

It is important to highlight that in any circumstance we tolerate any form of harassment, be it sexual, moral or of any other nature. Besides, we do no accept situations that might be considered disrespectful, intimidating or threatening in the relations among collaborators, independently of the hierarchical level.

5 - HEALTH AND SAFETY

NICCHIO CAFÉ prioritizes employees and collaborators’ health and safety. Everyone must know and follow safety policies and practices.

Each one is responsible for preventing accidents in the working environment and tend to the integrity of the infrastructure and the technical equipment.

Make sure you are aware of the procedure to be performed in case of an emergency situation.

6 - RELATIONSHIPS

Relationship with the client:
Relationships with the client must follow NICCHIO CAFÉ’s values and principles. Acting in conformity with the company’s culture and communicating in a clear manner, strengthens the brand’s credibility.
It is not allowed to take personal advantages in the relationships with the clients. It is necessary to keep the privacy of the required and given information from the client. NICCHIO CAFÉ also commits in respecting the client’s internal norms and policies.

Relationships with the suppliers:
The suppliers are important to our business results. Therefore, they must follow the Code of Conduct to avoid negative impacts on the image and reputation of the company, alongside with the possible civil or criminal accountabilities.
NICCHIO CAFÉ expects its suppliers to comply with their legal, social, environmental and health and safety obligations, and denies connections with companies which have the following conducts:
• Involvement with utilizing child labor, slave workforce exploitation or analogue to slavery.
• Nature environmental degradation and illegal nature-related practices.
• Acting in discord with intellectual property laws, acquiring products illegally.
• Involvement with corruption or anything that jeopardizes NICCHIO CAFÉ’s image and reputation.
• Relationships with collaborators which result in personal benefits.
All the admitted personnel, directly or indirectly, are considered business partners.

Press relationships:
It is forbidden to non-authorized personnel to make contact with the press or give any required information to journalists on behalf of the company. Contacting the press is done by the marketing department.
One must not offer benefits to journalists in exchange for positive media coverage. Professional ethics demands these relationships to be based on precise information, relevant and honest, in order to keep the company’s credibility and the readers or spectators’ trust to be preserved.

Relationships with the competitors:
NICCHIO CAFÉ is against any action that might limit free commerce or competition, especially illegal practices such as cartel formation, bidding frauds or power abuse.
The company adopts total commitment with contestant laws of obedience, working in accordance with responsible authorities and following the competition laws in order to discourage anti-competitiveness practices performed by third-parties.

Relationship with the community and the nature environment:
The company is committed to the economical and social development of the communities where it works and keeps open dialogue channels with each of them.
It is also committed to the ecosystem preservation and adopts sustainable practices.

Relationship with the government:
Providing information to municipal, state and federal public agencies must be always done in writing, through protocol and by the adequate orientation from the Legal Board. The provided information by the company must be clear and true.

Employees are prohibited from using the name of NICCHIO CAFÉ in personal matters related to the government.

7 - COMPANY ASSETS:

The company’s assets, equipment and infrastructure are exclusively for the operational use and must not be used for personal purposes, unless the company allows. It includes all the physical and intangible properties, such ad structure, inventory, information technology, intellectual property and the company’s information.

It is everyone’s responsibility to protect those assets and use them only for the expected purposes.

8 - INFORMATION SAFETY:

Inadequate use of the IT systems is forbidden due to possible virus attacks and information safety violations. Besides being illegal, using softwares or equipment via piracy may put information safety at risk.

OElectronic systems and informatics resources are for professional use, but may be used for personal purposes and long as they do not violate the internal norms and guidances, nor harm the work performance.

It is forbidden to give to third-parties, unauthorized by the board members, the company’s confidential information, such as trades, internal processes, costs and profits, except when required by governmental and regulatory agencies, upon approval from the responsible department.

The collaborator must also observe the norms of the general data protection laws (in Portuguese Lei Geral de Proteção de Dados - LGPD) to guarantee that third-parties’, such as clients and suppliers, data is not shared.

9 - MONEY LAUNDERING, GIFTS AND HOSPITALITY

The company does business only with clients, suppliers, partners and service providers who have legal fund origin. NICCHIO CAFÉ is against money laundering and all collaborators must act with integrity in dealings and relationships.

Gifting is a cordial practice, as long as it is not used to obtain benefits in dealings and are of irrelevant costs, such as pens and agendas. It is important that it nevers influences decision making.

Collaborators invited to participate in sponsored events, or those promoted by partners/suppliers or commercial relationship personnel/companies, can only accept the invitation after formal approval from the responsible board of directors.

10 - REPORTING CHANNEL

NICCHIO CAFÉ provides reporting, complaints and suggestions via email. Reportings must be done when the complainant is aware of correct data, facts or behaviors that fit into any of the hypotheses forbidden by this Code of Conduct, Ethics and Integrity.

All reports and complaints will be directed to the board of directors, for preliminary rating and arrangements.
